OPEN LISTING AGREEMENT

1.      This listing agreement made on this ________________ day of 

_____________________, 19_____ , between _______________________ and 

_______________________________ who agree as follows:

2.      Listing term:  Owner lists the property described in Paragraph 3,

with BROKER for a period of ___________________days.

3.      Description of Property:  The property listed is described as:



4.      Commission:  OWNER agrees to pay BROKER a commission of _______%

of the sale price if BROKER finds a purchaser ready, willing and able to 

pay at least $__________________ for the property (or such other price as 

may be acceptable to Owner).

5.      Non-Exclusive:  Owner retains the right to sell the property on 

his/her own account with no sales commission due broker provided BROKER did

not find buyer.  OWNER may further list the property with other brokers.

If a sale is made within ______________ months after this agreement ter-

minates to a party found by BROKER during the term of the agreement, such

party having been disclosed to OWNER before the expiration of the agreement,

then OWNER shall pay the commission specified above.

6.      Forfeit of Deposit:  Should a deposit be forfeited by a purchaser,

then one-half of said deposit shall be retained by BROKER (if this amount 

does not exceed the commission) and one-half shall be paid to OWNER.
