As I've mentioned in emails, after reading Saskatchewan law I don't see any reason for an installment sale to require foreclosure, not the way I practice them anyway. If you want to use them I suggest taking the matter up with another lawyer. Keep in mind that lawyers have told me AFS won't work in Ontario either, but they were obviously wrong.

If you DON'T want to use AFS, then there's nothing wrong with using Lease Options if you're comfortable with the pros and cons.

After all of my research and personal experience, my preference is AFS for the following reasons:

1. I believe I'm more likely to be effected by rent control and forced repairs, than I am by a successful equitable interest lawsuit.

2. I can eject a buyer in 1 month under an AFS, same as a lease.

3. If it ever comes to forcing a buyer out. I would rather have him/her liable for a purchase contract rather than only a lease (remember the option is enforcable only upon you, the seller).

The above are my reasons for doing what I do. But the fact is that I haven't had to deal with any of these problems. The worst thing that's ever happened is a buyer did a crappy home improvement job that I had to redo when his marriage fell apart and he gave the house back.

As I'm sure I've said before: Every investor needs to understand the pros and cons of whatever method they want to use and be comfortable with the cons and how to deal with them should they ever arise.

If you do decide to use Lease Options there certainly is a ton of information available for free and in books and courses to help you structure it for your protection.
