Darren, in Ontario I don't need to go to court to evict someone with an AFS, but I would to get the judgement. So the worse half of the scenario (getting the buyer out) is hardly any different than a lease eviction. But the second half (getting the judgement) could be more troublesome than what you've described.

In Ontario we have the Rental Tribunal which handles all landlord/tenant disputes. You can apply for an eviction yourself but most people hire a lawyer.

You may indeed be better off in Saskatchewan with a Lease Option in that particular scenario. Just make sure you don't lose out in the process of protecting yourself.

If you can get the same cash flow and down payment on a Lease, and you don't mind having no recourse on the Option, and you have a quicker solution to worst case scenarios. Then by all means, the L/O is a better choice!
