Hi Darren - Thanks a bunch for the advice. I needed to know that I was on the right track here. My gut feel for this tenant is that he never had any intention of paying his rent - it just took him 3 payments to figure out that he wasn't enjoying it. My biggest mistake was actually believing that he was having a teensy weensy problem coming up with first and last - but that he would pay every 2 weeks until he caught up and then revert back to paying once a month. Well - that didn't work and coming into the 4th payment date, he just flat out refused to pay any more rent. I will follow through with the hearing process but I am also going to make it known that he needs to get out because of health reasons - there is mould in the bedroom (something I found out just prior to closing) In actual fact the place needs some major renovations. Fact is - nobody should be living in there right now regardless.
I like the ide of taking pictures, so I will do that before the hearing. A reason that he used for not paying any more rent was that I wasn't doing anything about water seeping in during rain storms. The one and only time he said that he had water coming in (he called late in the evening) I told him I would have a contractor around the next morning. The contractor couldn't immediately see where the problem came from and suggested that i call him the next time it happened and he would go around while the problem was occuring. Well - the tenant never called again with the problem - even though we had another storm shortly after.
Yes I am in Ontario. I have contacted my Real Estate Agent ( a family member) and he is going to ask around to find out how other Landlords deal with these situations.
He is also smoking in the house which is turning off any prospective tenants - so a picture of an ash tray would be good I think.
