First, you need to talk to an attorney. Your divorce lawyer is probably a good place to start.

It would probably be best/easiest to force the property sale as part of the divorce settlement. If that doesn't work, then you will need to back to court to force the sale. I assume your ex can't afford to buy you both out and payoff the debt. So partitioning the property doesn't really help. The court can force the sale.
