our property (below referred to as the '25.66 acre tract') is landlocked, as such we have a 'non-exclusive easement for ingress and egress" across 2 properties. in addition, one of those properties (the 49.11 acre tract) has access across ours to the upper portion of that property (it wraps around on 2 sides) this neighboring property has recently been sold to a real estate firm. my question is, who is allowed to utilize this easement? is it limited to the property owners, or to anyone and their cousin who wants to visit that property? also, since that property wraps around ours, is there some way we can insist they cut their own drive in if that property is to be subdivided? the exact wording follows:
"Together with a perpetual non-exclusive easement for ingress and egress over a 49.11 acre tract also shown on the above mentioned survey, said easement being the '20' ingress/egress easement centered along existing road'."
"Subject to the reservation of a perpetual non-exclusive easement for the ingress and egress over the 25.66 acre parcel conveyed ehrein for the benefit of the 49.11 acre tract, said easement being the '20' ingress/egress easement centered along the existing road'. "
